CONTRACT LODGING RIGHTS AND OBLIGATIONS

1. SUBJECT MATTER

By virtue of this contract the extra-hotel company, hereinafter the ACCOMMODATION will provide accommodation to the HUESPED in the room and its accessories, in exchange for a price, for the number of days indicated on the Hotel Registration Card.

1.1.- The room and the price or rate per night will be those that appear on the Registration Card. Notwithstanding the above, the ACCOMMODATION shall be entitled to make a change of room and the guest must accept it, provided that it is a room of equal or better conditions or due to a situation of force majeure.

1.2.- Check in time is from 14:00 (1:00 pm) on the day of arrival and check out time is until 11:00 (11:00 am) on the day of departure. The period of time between one hour and the other corresponds to the hotel day. Early check in or check out after the indicated time will be subject to availability and the GUEST will have to pay the corresponding value.

1.3.- The accommodation will be provided irrespective of the time the GUEST actually stays in the room. Partial use results in the payment of the full rate.

1.4.- The provision of the services object of the contract and those complementary services offered by the ACCOMMODATION will be subject to availability and to the schedules, shifts or physical stock of supplies, goods, facilities or spaces for it.

2. PRICE

2.1.- The price of the present contract corresponds to the fee per night that the HOST is obliged to pay and which amounts to the sum indicated on the registration card including taxes, all of which will be described in the corresponding invoice. If taxes do not apply, because it is an exempt or excluded operation, the invoice will apply the value of the rate without taxes.

2.2.- The HOST must also pay all charges for food, beverages, laundry and in general for all those generated during his stay and that he decides to charge to his account.

2.3.- The GUEST declares that he/she has been informed of the rates, fees and in general room prices per night with taxes. The rates may vary from one night to the next.

2.4.- The non-fulfilment of the agreed payment will generate interest for late payment at the maximum rate allowed, as certified by the Financial Superintendence.

3.- OBLIGATIONS:

3.1.- OF THE ACCOMMODATION

3.1.1.1.- To provide the service that is the object of the contract.

3.1.2.- To attend to, receive, process and respond to any suggestions, complaints or claims presented by the guest.

3.1.3.- Any other duties established by law.

3.2.- OF THE GUEST.

3.2.1.- Identify himself/herself to register at the ACCOMMODATION with a valid identity document. For minors, a valid identification document must be presented.

3.2.2.- To pay the value of the accommodation plus the corresponding taxes.

3.2.3.- To pay the value of all the consumptions and charges made to your account.

3.2.4.- To observe a decorous conduct and to dress appropriately.

3.2.5.- To respond to the slightest fault of their obligations and those of their companions or guests.

3.2.6.- To register at the ACCOMMODATION reception desk all companions or guests of the GUEST going to their room and to pay the corresponding fee or value for each one of them.

3.2.7.- To respect the number of persons per room.

3.2.8.- THE HOSPITALITY acknowledges that the practice of sports, physical exercises, driving of vessels or vehicles, use of instruments or tools and in general any activity that means a risk or that could be considered as a dangerous activity, will be their decision, under their exclusive responsibility and implies that the HOSPITALITY has the skills and knowledge that allows them to assume such risks, exonerating the LODGING and its officials or employees of any responsibility in case they suffer any damage or injury.

3.2.9.- To use the furniture, fixtures, equipment and in general the facilities of both the room and the ACCOMMODATION, in an appropriate manner, keeping them in the state in which they are and therefore will be liable for any damage or loss of the elements and goods of the ACCOMMODATION, even for slight fault. In the event of total or partial loss or damage to the property of the ACCOMMODATION due to a cause attributable to the HOST or his/her belongings, the latter will recognise the price fixed by the ACCOMMODATION, plus an additional 50% by way of penalty.

3.2.10.- To respect the authority of the Manager of the ACCOMMODATION.

3.2.11.- To allow the right of inspection and/or surveillance of the room by officials of the ACCOMMODATION. This right shall be exercised within the limits established by the laws in force.

3.2.12.- Allow the employees and officials of the ACCOMMODATION access for routine work and cleaning of the room.

4. TERMINATION OF THE CONTRACT

The hosting contract shall terminate in the following events:

4.1- By expiry of the agreed term.

4.2.- For non-fulfilment of any of the obligations of the parties and punctually for non-payment of the price or canon payable by the HOST or for non-payment of food and beverages or other complementary services that the HOST had charged to the room or to his/her personal account.

4.3.- In the event that, in the sole opinion of the LODGING, the behaviour or attire of the GUEST is not appropriate, or in the opinion of the LODGING is detrimental to the tranquillity and/or health of the other guests or visitors to the LODGING. Paragraph: The termination of the contract does not exonerate or release the HOST from the payment of outstanding balances.

5. EFFECTS OF TERMINATION

5.1.- Upon termination of the contract, the ACCOMMODATION may freely dispose of the room.

5.2.- Upon termination of the contract and regardless of the cause of termination, the LODGING is entitled to enter the room, prepare and sign an inventory of the effects and luggage of the guest in the presence of two (2) witnesses, and remove them from the room to leave them in a safe and adequate deposit, without liability of the LODGING and at the risk and expense of the GUEST.

5.3.- THE ACCOMMODATION has the right of retention over the luggage and goods of the GUEST that are in the room and, therefore, if there is any balance owed by the GUEST, the ACCOMMODATION will not deliver the luggage and goods until the total outstanding balance is paid in full.

6. MISCELLANEOUS

6.1. Legal nature of the contract. The accommodation contract is a lease contract, of a commercial nature and of adhesion.
6.2.- The lodging contract is proved by means of the hotel registration card issued by the ACCOMMODATION, accepted by the signature of the HOST, which states that he/she adheres to the stipulations herein. The HOSPITALITY HOLDER expressly accepts that the liquid sum of money stated in the invoice will be enforceable. The HUESPED authorizes the ACCOMMODATION to fill in the blanks on the hotel registration card.
